General Conditions

§ 1 Scope
(1) As a provider of training and further education for group fitness, fitness and personal trainers, we offer our seminars, services and products exclusively on the basis of the following General Terms and Conditions (GTC). Our special additional conditions under §§ 10 ff. of these General Terms and Conditions also apply to our HOT IRON® events.

(2) These General Terms and Conditions apply exclusively to business customers in their capacity as entrepreneurs.

(3) Differing, supplementary or conflicting general terms and conditions of the participant or business customer do not become part of the contract unless we have expressly agreed to their validity in writing.

(4) These General Terms and Conditions also apply to all future business relationships, even if they are not expressly agreed again.


§ 2 Conclusion of contract
(1) The presentation of our service offers on our website: www.experts-united.world does not represent a binding offer, but rather a non-binding invitation to book these offers with us.

(2) The business customer's order/booking is a legally binding offer to conclude a corresponding contract.

(3) Registration for one of our training and further education events takes place exclusively online via our website: www.experts-united.world.

(4) By registering for one of our events, the business customer declares that he or she meets the entry requirements, if any, and is in a healthy, efficient physical condition. This includes 100% attendance and appropriate active participation in our training and further education events.

(5) The number of participants in our events is usually limited. Registrations are considered in the order of receipt.

(6) When registering via our website, the business customer immediately receives confirmation of access via an authorized email. The confirmation of receipt does not constitute a binding acceptance of the registration. However, the confirmation of receipt can be combined with the declaration of acceptance.

(7) The contract is only concluded when we send the business customer the registration confirmation by email, post or fax. The registration confirmation includes a link to an overnight accommodation provider and directions to the event location. These providers are third-party providers and have no connection to the IFHIAS Institute. Information about the event can be found on our website: www.experts-united.world.


§ 3 Participation fees and payment conditions
(1) The course fees published at the time of registration on our website: www.ifhias.de or in the corresponding catalogs apply. The fees are the final price (net price plus VAT). The course fees only include the price of the event, the seminar documents and the confirmation of participation.

(2) Promotional offers are limited to the specified period. In order to redeem the booking, the original vouchers must be enclosed and provided with the subscription number. Subsequent consideration is not possible in each case. Discounts and discounts from promotions are mutually exclusive, meaning only one discount or discount can be claimed for each booking. Package bookings are excluded from discounts.

(3) The course fees are paid exclusively via the external payment provider PAYONE. The fees are due upon booking (regardless of the event date). If you register for events at short notice, the event fee must be received by the day of the event. In the event of late payment, we are entitled to demand default interest of 9 percentage points above the current base interest rate of the German Federal Central Bank. A reminder fee of 5.00 euros will be charged for each reminder letter that is sent to the business customer after the default has occurred.


§ 4 Cancellation/rebooking
(1) Cancellations of one of our events booked by business customers must be made in the customer account on www.experts-united.world. The following additional costs will be charged if the business customer cancels the registration:

· a processing fee of 48.00 euros will be charged up to 14 days before the start of the event;
· 50% of the regular course fees or at least EUR 48.00 must be paid up to 3 days before the start of the event;
· If you cancel later or do not appear at the event without prior cancellation, you will be charged 100% of the regular course fee or at least EUR 48.00.


The decisive factor for the time is when we receive the cancellation. We recommend taking out seminar insurance from an insurance provider.

(2) Rebookings can be carried out for a fee of 30.00 euros including VAT. Rebookings must be made in the customer account on www.ifhias.com. A rebooking only occurs if the new desired participation date is communicated or booked at the same time as the written rebooking request. Otherwise it is a cancellation that is only possible within the above conditions.

The following applies to training courses with e-learning: A rebooking is only possible if the training itself remains the same (i.e. only a rebooking of the appointment). It is no longer possible to rebook to a different training content or cancel once e-learning begins.

(3) In the event of a new issuance of invoices, certificates or similar certificates, which is necessary due to incorrect information provided by the customer when booking, creating the customer account or similar, a processing fee of EUR 30 or more (depending on the effort) will be charged. raised.


§ 5 Changes
(1) If circumstances arise for which we are not responsible, e.g. illness or other absence of a speaker, we reserve the right to move the event in terms of location and/or time, to use an adequate speaker as a replacement or to cancel the event. If the minimum number of participants is not reached, we reserve the right to postpone or cancel the respective event. As far as possible, we will inform the participating business customer about this one week before the event.

(2) If we cancel an event without replacement, participation fees that have already been paid will be refunded.

(3) We also reserve the right to make necessary content and organizational changes and deviations before and during the seminar, provided that these do not significantly change the overall character of the announced event. We also reserve the right to change the dates and times printed in the current seminar program as well as the seminar location. We will inform participating business customers immediately of any necessary changes.

(4) Participating business customers have no further claims, in particular claims for damages (including cancellation fees for travel and hotel costs) in the event of changes or cancellation of an event.


§ 6 Event documents / copyright
(1) Documents and documentation provided as part of the events are protected by copyright and may not be reproduced, reprinted, translated, otherwise reproduced or published or passed on to third parties, even in extracts, without express written consent.

(2) The copyright use and exploitation rights of all publications lie with us and their further use of any kind, in particular reproduction or distribution to third parties, requires the prior written consent of our management.

(3) With his registration, the business customer submits a cease and desist declaration to the effect that he owes a contractual penalty of 3,000.00 euros for violations of our copyright provisions. Further claims for compensation are not affected by this.

After attending an IFHIAS event, the participant is prohibited from participating in the development, co-development, further development, presentation, training or similar of competing programs. Furthermore, the participant may not act as an instructor or presenter of the IFHIAS programs, e.g. at conventions, travel events, etc. A contractual penalty of €2,500 plus VAT shall apply for the first case, and €1,000 plus VAT shall be deemed agreed for each subsequent case.


§ 7 Liability
(1) We are liable in accordance with the statutory provisions if the business customer asserts claims for damages that are based on intent or gross negligence, including intent and gross negligence on the part of our representatives or vicarious agents. Unless we are accused of an intentional breach of contract, liability for damages is limited to foreseeable, typically occurring damage.

(2) We are not liable for slightly negligent breaches of secondary obligations that are not cardinal obligations.


§ 8 Newsletter
(1) When registering for an event, the name and email address are automatically entered in the information area. You can unsubscribe at any time by clicking the “Unsubscribe from the newsletter” button in the newsletter.


§ 9 Final provisions
(1) Should individual provisions of these General Terms and Conditions be or become ineffective in whole or in part, this will not affect the validity of the remaining provisions. The wholly or partially ineffective regulation must be replaced by the legal regulation that comes closest to the economic purpose of the ineffective regulation.

(2) The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is the headquarters of IFHIAS International GmbH.


Special additional conditions for HOT IRON® events:

§ 10 Personal requirements
By registering for the HOT IRON® Instructor training, the candidate declares that they have training as a trainer in the field of fitness or aerobics (or equivalent knowledge) and that they are in healthy physical condition for all of our training and further education. This includes 100% attendance at training and further education.


§ 11 Purpose of the course
We, IFHIAS International GmbH, Dieselstr. 1 A, 21465 Reinbek, Germany, represented by managing director Kai Schumacher, are the licensee of, among other things, the protected word mark HOT IRON®. The IRON SYSTEM® and its HOT IRON® programs are a training program developed based on sports science and may only be passed on to end users by our licensed, specially trained and qualified instructors.

The aim of the event is to acquire or extend the HOT IRON® INSTRUCTOR LICENSE required by the business customer to offer and implement IRON SYSTEM® programs and is limited to 8 quarters. By passing the practical final exam and the subsequent online theory exam - one week after the last course weekend of the HOT IRON® instructor license training - the participant acquires the right to use the protected name HOT IRON for a period of 4 quarters ®, to be able to call yourself a HOT IRON® Instructor and as such to convey HOT IRON® 1 and 2 as well as HOT IRON® CROSS to end customers.


§ 12 Duration of the course
The training to become a HOT IRON® Instructor lasts a total of four days and takes place over two weekends. It ends with passing the practical final exam and the subsequent online theory exam, one week after the last course weekend of the HOT IRON® Instructor License training.


§ 13 Process of the courses
(1) The training to become a HOT IRON® Instructor has the following process:

· E-Learning 1: Preparation for Module 1 online
· In-person training for Module 1 (one weekend)
· E-Learning 2: Follow-up to Module 1 and preparation for Module 2 online (e-learning)/exam simulation theory test online
· face-to-face training Module 2 (one weekend) including license practical test
· license theory test online


Before the start of the training, the candidate undertakes by means of a preventative cease and desist declaration not to identify themselves as HOT IRON® or HOT IRON® without a valid license . HOT IRON® CROSS Instructor or to give his classes the name HOT IRON® or HOT IRON® CROSS.
The e-learning consists of several learning modules, each of which ends with learning success checks and, like the face-to-face phase, is part of the event. The learning success checks consist of questions that are to be answered using multiple choice. Only after the respective learning success control has been successfully completed will the following learning module be activated. Admission to the following attendance phase only occurs after successful completion of the entire previous preparatory module.
The practical exam extends over the entire second attendance module. One or more teaching samples as well as the further development, learning and group behavior, etc. of the examinee are taken into account in the speaker's assessment. The theory test takes place by answering multiple choice questions based on the pattern of learning success assessments. Only after passing both exams can the candidate call themselves a HOT IRON® Instructor and use the protected name HOT IRON® for their classes.
In the first step, the validity of the license extends over 4 quarters from the time it was granted. Before the end of the year, the license can be extended for another 4 quarters by successfully collecting license points.

(2) The course of the "HOT IRON®enterTRAINment" event is as follows:

· E-learning: Preparation for the presence phase online
· Face-to-face training


Whether participation was successful will be assessed by the respective speaker. One or more teaching samples as well as the further development, learning and group behavior of the examinee are taken into account in the speaker's assessment. With successful participation, license points are collected to obtain the HOT IRON® Instructor license.


§ 14 License points
A total of 48 points must be collected within 8 quarters (i.e. two years).
IMPORTANT: 12 points must be collected within the first 4 quarters. Otherwise, the HOT IRON® Instructor license expires after just 4 quarters. It is not possible to transfer more than 48 points within the license period! The extra points expire at this point.

Points can be obtained as follows:

· Further training:


o HOT IRON® training = 15 points

o HOT IRON® enterTRAINment (half-day event over 4 hours; e-learning in advance) = 6 points

o HOT IRON® online training (pure e-learning) Learning without live training) = 6 points

o BOOSTAR® training = 6 points


o KORCE® training = 6 points

o YONGA® training = 6 points





· HOT IRON® Experts World:



o Per quarter membership: 3 points


Special additional conditions for the HOT IRON® Experts World


§ 15 Scope of services and participation requirements
(1) The prerequisite for membership in the HOT IRON® Experts World is a valid “HOT IRON® Instructor” license.

(2) When you book the HOT IRON® Instructor training, a trial quarter of ‘EXPERT3’ of the HOT IRON® Experts World is already included. This will be activated after successful completion of the e-learning (trial quarter = current quarter at the time the e-learning is completed) and is automatically extended by a further 4 quarters if it is not cancelled up to one day before the end of the trial quarter.

(3) The following memberships are offered:

· EXPERT2 with combination 1
· EXPERT2 with combination 2
· EXPERT2 with combination 3
· EXPERT3 with combination 4


The combination provides information about the selected training plan combination. Each of these training plan combinations is linked to the participant's specific qualifications.

(4) The following training plan combinations can be booked:
- EXPERT2 membership with combination 1

· The member receives a new choreography HOT IRON® 1 and HOT IRON® 2 every quarter, including HOT IRON® music (suitable for HOT IRON® 1 and HOT IRON® 2). The minimum requirement for EXPERT2 membership with Combi 1 is the HOT IRON® Instructor license.


- Membership EXPERT2 with Combi 2

· The member receives a new choreography HOT IRON® 1 and HOT IRON® CROSS every quarter, including HOT IRON® music (suitable for HOT IRON® 1 and HOT IRON® 2, music for HOT IRON® CROSS freely selectable according to trained specifications). The minimum requirement for EXPERT2 membership with Combi 2 is the IRON CROSS Instructor license or the IRON SYSTEM® Instructor license or the HOT IRON® Instructor license from 2018


- EXPERT2 membership with Combi 3

· The member receives a new choreography HOT IRON every quarter ® 2 and HOT IRON® CROSS, including HOT IRON® music (suitable for HOT IRON® 1 and HOT IRON® 2, music for HOT IRON® CROSS freely selectable according to trained specifications). The minimum requirement for EXPERT2 membership with Combi 3 is the IRON CROSS Instructor license or the IRON SYSTEM® Instructor license or the HOT IRON® Instructor license from 2018


- EXPERT3 membership with Combi 4

· The member receives a new choreography HOT IRON every quarter ® 1, HOT IRON® 2 and HOT IRON® CROSS, including HOT IRON® music (suitable for HOT IRON® 1 and HOT IRON® 2, music for HOT IRON® CROSS freely selectable according to trained specifications). The minimum requirement for membership EXPERT3 with Kombi 4 is the IRON CROSS Instructor license or the IRON SYSTEM® Instructor license or the HOT IRON® Instructor license from 2018


(5) The following additional services are granted as part of the IRON SYSTEM® Experts World membership :

quarterly training plans printed out - completely "pre-choreographed" to the current HOT IRON® music (for HOT IRON® 1 and HOT IRON® 2)
· for the current release: instructional videos and tips on specific exercises (time-limited service)
· Listing in the IFHIAS online instructor search


§ 16 Duration of membership Membership
is completed online in the IFHIAS customer account via ifhias.com. The type of membership is selected there.
The membership runs for 4 quarters from booking and is extended for a further 4 quarters unless canceled in writing 6 weeks before the end of the term. Termination takes place via the IFHIAS customer account. Regardless of this, membership expires immediately if the HOT IRON® Instructor license expires. After termination or termination, access to Experts World and all of its contents expires.
In individual cases, we reserve the right to apply different notice periods upon presentation of a medical certificate by the member if the member's state of health prohibits physical activity.


§ 17 Membership fees
The following fees apply for booking the respective training plan combinations for a period of 4 quarters:

· EUR 40 (gross) per quarter for combination 1, 2 or 3, provided that a one-off payment is made for all 4 quarters;
· EUR 43 (gross) per quarter for combination 1, 2 or 3, provided quarterly payment is made;
· EUR 50 (gross) per quarter for Combi 4, provided a one-off payment is made for all 4 quarters;
· EUR 53 (gross) per quarter for the combination 4, provided quarterly payment is made.


The membership fee is paid when the membership is completed exclusively via the external payment provider PAYONE.


§ 18 Miscellaneous
It is possible to upgrade from EXPERT2 to EXPERT3 online. This does not extend your membership. A downgrade is not possible.


Special additional conditions for YONGA® Experts World


§ 19 Scope of services and participation requirements
(1) YONGA® is a pre-choreographed group fitness program and can only be offered and taught by instructors who are members of the YONGA® Experts World. Membership can be completed after successful participation in the training. The prerequisite for membership in the YONGA® Experts World is therefore successful participation in the “YONGA® Basic” training course.

(2) When you book the YONGA® Basic training, a trial quarter of the YONGA® Experts World is already included. This is activated after you receive the confirmation of participation (trial quarter = current quarter at the time of confirmation of participation) and is automatically extended by a further 4 quarters if it is not cancelled up to one day before the end of the trial quarter.

(3) The following additional services are granted as part of the YONGA® Experts World membership:

· quarterly training plan printed out - completely “pre-choreographed” to the current YONGA® music
· listing in the IFHIAS online instructor search
· for the current release: instructional videos and Tips on specific exercises (limited time service)


§ 20 Duration of membership
Membership is completed online in the IFHIAS customer account via ifhias.com.
The membership runs for 4 quarters from booking and is extended for a further 4 quarters unless canceled in writing 6 weeks before the end of the term. Termination takes place via the IFHIAS customer account. After termination, access to YONGA® Experts World and all its contents expires.

In individual cases, we reserve the right to apply different notice periods upon presentation of a medical certificate by the member if the member's state of health prohibits physical activity.

§ 21 Membership fees
The following fees apply for booking membership for a term of 4 quarters:

· EUR 30 (gross) per quarter, provided a one-off payment is made for all 4 quarters;

· EUR 33 (gross) per quarter, provided quarterly payment is made;


The membership fee is paid when the membership is completed exclusively via the external payment provider PAYONE.



Special additional conditions for the KORCE® Experts World

§ 22 Scope of services and participation requirements
(1) KORCE® is a pre-choreographed group fitness program and can only be offered and taught by instructors who are members of the KORCE® Experts World. Membership can be completed after successful participation in the training. The prerequisite for membership in the KORCE® Experts World is successful participation in the “KORCE® Basic” training course.

(2) When you book the KORCE® Basic training, a trial quarter of the KORCE® Experts World is already included. This is activated after you receive the confirmation of participation (trial quarter = current quarter at the time of confirmation of participation) and is automatically extended by a further 4 quarters if it is not cancelled up to one day before the end of the trial quarter.

(3) The following additional services are granted as part of the KORCE® Experts World membership:

· quarterly training plan printed out - completely “pre-choreographed” to the current KORCE® music
· listing in the IFHIAS online instructor search
· for the current release: instructional videos and Tips for specific exercises (time-limited service)


§ 23 Duration of membership
Membership is completed online in the IFHIAS customer account via ifhias.com.
The membership runs for 4 quarters from booking and is extended for a further 4 quarters unless canceled in writing 6 weeks before the end of the term. Termination takes place via the IFHIAS customer account. After termination, access to the KORCE® Experts World and all of its contents expires.

In individual cases, we reserve the right to apply different notice periods upon presentation of a medical certificate by the member if the member's state of health prohibits physical activity.

§ 24 Membership fees
The following fees apply for booking membership for a term of 4 quarters:

· EUR 30 (gross) per quarter, provided a one-off payment is made for all 4 quarters;

· EUR 33 (gross) per quarter, provided quarterly payment is made;


The membership fee is paid when the membership is completed exclusively via the external payment provider PAYONE.




Special additional conditions for the BOOSTAR® Experts World

§ 25 Scope of services and participation requirements
(1) BOOSTAR® is a pre-choreographed group fitness program and can only be offered and taught by instructors who are members of the BOOSTAR® Experts World. Membership can be completed after successful participation in the training. The prerequisite for membership in the BOOSTAR® Experts World is successful participation in the “BOOSTAR® Basic” training course.

(2) When you book the BOOSTAR® Basic training, a trial quarter of the BOOSTAR® Experts World is already included. This is activated after you receive the confirmation of participation (trial quarter = current quarter at the time of confirmation of participation) and is automatically extended by a further 4 quarters if it is not cancelled up to one day before the end of the trial quarter.

(2) The following additional services are granted as part of the BOOSTAR® Experts World membership:

· quarterly training plan printed out - completely “pre-choreographed” to the current BOOSTAR® music
· listing in the IFHIAS online instructor search
· for the current release: instructional videos and Tips for specific exercises (time-limited service)


§ 26 Duration of membership
Membership is completed online in the IFHIAS customer account via ifhias.com.
The membership runs for 4 quarters from booking and is extended for a further 4 quarters unless canceled in writing 6 weeks before the end of the term. Termination takes place via the IFHIAS customer account. After termination, access to the BOOSTAR® Experts World and all of its contents expires.

In individual cases, we reserve the right to apply different notice periods upon presentation of a medical certificate by the member if the member's state of health prohibits physical activity.

§ 27 Membership fees
The following fees apply for booking membership for a term of 4 quarters:

· EUR 30 (gross) per quarter, provided a one-off payment is made for all 4 quarters;

· EUR 33 (gross) per quarter, provided quarterly payment is made;


The membership fee is paid when the membership is completed exclusively via the external payment provider PAYONE.
